Auto Insurance Claims: Someone hit my open car door., who is at fault
QuestionI was parked on a downtown street with plenty of room for cars on both sides to drive slowly down. Its a busy downtown with lots of pedestrians. I had my door open and was attempting to get out when an 83 year old man hit my door on the inside edge and dented it. I called the cops for the incident report and the old man told him I wildly swung the door open in front of his car. I am just wondering who will they believe is at fault for this?

SEC. 63-3-911. Opening door of stopped motor vehicle.
No person shall open any door on a motor vehicle unless and until it is reasonably safe to do so and can be done without interfering with the movement of other traffic, nor shall any person leave a door open on a side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.
