Auto Insurance Claims: Insurance negotiations, kids injury settlement
QuestionIts been about 2 months since my son was hit by a car while riding his bike to school. At this time the insurance has not officially said they are %100 fault. There is no doubt in my mind that their driver was negligent. My son was taking a right turn, she was coming from the opposit way taking a left turn onto the same street. I have 2 eyewitnesses. We took him to the hospital and they did a cat scan..everything turned out ok..however for the next 2 weeks my son complained about headaches. His behvior seems more aggressive, very emotional. He has had some memory loss. I finally took him to see a neurologst to have them diagnose him and he did suffer a concussion. This can be an on going situation and now he needs to rest. At this point I need to contact the agent to tell him about the concussion. Because of the head injury and the possibility of further visits how much should I expect or ask for.
AnswerI wouldn't expect over $2000.00, and that is if there is clear evidence of a concussion and the medical bills are at least $800.00. If there is $350.00 in medicals and just the complaint of headaches, the treatment for a concussion is rest, so there isn't much in future medicals. To get future medical settlements, you need a doctor to write down what is likely to be needed in the future and the associated costs. Liability is always questionable when a bicycle and car have a wreck on an official roadway. Both vehicles must abide by traffic laws, so it is a strike against the younger driver with less experience.
