QuestionI was recently a passenger in an auto accident in which the driver of the other
car was found to be at fault. The problem I have is that I was recently taken
off my Stepfather's insurance policy after I sold my car and was going to go
on my girlfriend's policy. I did not move out of the house of my mother and
stepfather at the time of the accident.
I am wondering who would pay for my medical expenses. Would it be paid
for by the driver of the car I was in or by my stepfather's because I would be
a resident relative? My stepdad called to report the accident but they stated
that I dropped out of the policy and needed to call the other insurance
company that I was suppose to sign up with but didn't.
AnswerIt depends on the laws of your state. Each is different. However, in most states, you would receive medical coverage from 2 sources: (1) the policy of the vehicle in which you were a passenger and (2) the policy of the driver who caused the accident. You should call the claim reps at both insurers and ask what benefits are available to you.
