when the driver at fault does not put in his claim after more than 3months of waiting? the insurance won't pay for the damages until driver claims!

If there is a police report tat shows who is at fault, you should send it to the insurance company. That may help them to make a decision. If you have the other drivers name and address, you could send him a letter telling him to contact his insurance comapny or you will sue him.
Another option is to put the claim through your own insurance if you have collision coverage. Other than that, the only thing you can do is to file a law suit against the at fault driver.
