Motorcycle Repair: stock muffler repacement, stock muffler, straight pipe

I have a 1992 yamaha big bear 350 4x4 converted to a 2 wheel drive.  I would like to take the stock muffler off and run a straight pipe out the back end and up for submarine purposes.  Can I do this?  Is it legal? Will it increase performance?

A: Yes

Q: Is it legal?
A: Is legal for racing purposes, otherwise EPA violation.

Q: Will it increase performance?
A: Should, but carb tuning will be necessary.
